However, local authorities should work with the person to avoid such circumstances wherever possible by ensuring that any potential emergency needs are identified as part of the care and support planning stage and planned for accordingly.<\/li>\n<\/ul>\nA Person-centred Process<\/h2>\n
Researchers, practitioners, and the rest of us know just how important healthy friendships can be. Recognizing their value, we need to ensure that we do all that we can to support and maintain these most valuable well-being assets. Signposting to help \u2013 if people are struggling it isn\u2019t your place to solve their problems, heal or cure them. Instead you should be directing them to people and organisations that are best placed to assist. That might be their GP\/Family Doctor, NHS website, pharmacy, local council, MP, or charities that could help with their health, rights, finances, housing, wellbeing etc.<\/p>\n
However, in all but a very small number of cases, such as where a person is being placed under guardianship under Section 7 of the Mental Health Act 1983, a person has a right to refuse to enter a setting whether that is on an interim or permanent basis. Where a person unreasonably refuses the arrangements, a local authority is entitled to consider that is has fulfilled its statutory duty to meet needs and may then inform the person in writing that as a result they need to make their own arrangements. This should be a step of last resort and local authorities should consider the risks posed by such an approach, for both the authority itself and the person concerned. Should the person contact the local authority again at a later date, the local authority should reassess the needs as necessary and re-open the care and support planning process. As part of that, the local authority must provide the person with a personal budget, except in cases or circumstances set out in the Care Act (Personal Budget) Regulations.<\/p>\n
